RESOLUTION 5477 OF 2022 includes various sections in its text regarding discretion. Specifically, its preamble states: It is at the discretion of the national Government, based on the principle of state sovereignty, to authorize the entry and stay of foreigners in the country, determining the conditions or requirements for doing so, as well as the reasons or motives for leaving and/or exiting the national territory.
This legislation additionally includes in its ARTICLE 3. DEFINITIONS. For the purposes of this resolution, the following terms shall be understood as: Visa: A visa is the authorization granted by the Visa and Immigration Authority to a foreigner for their entry, stay, and engagement in activities within the national territory. Its granting is of a sovereign and discretionary nature by the national Government and does not constitute a right of the applicant. It can be presented as a stamped label or as an electronic visa.
Finally, it again refers to discretion in migration matters in its ARTICLE 100. NON-APPEALABILITY OF DECISIONS. In consideration of the discretionary authority of the Colombian State to authorize the entry and stay of foreigners in the national territory, administrative appeals are not applicable against the pronouncements or decisions of the Visa and Immigration Authority regarding the approval of a visa and the validity period granted; or on the inadmissibility, requirement, denial, termination, and cancellation of visas.
